Terms and Conditions
These terms apply to Boni websites, products, software, APIs, and related business services. Enterprise deployments may also be governed by separate written agreements.
Use of Services
These Terms apply to Boni One websites, software, APIs, admin portals, integrations, and related services operated by Bohni Tech Private Limited, Bangalore, Karnataka, India. Separate written agreements, order forms, DPAs, or service schedules may apply to enterprise customers and will control where they conflict with these Terms.
By accessing or using Boni One, you agree to these Terms and our Privacy Policy. You may use Boni One only for lawful business purposes and in accordance with these Terms, applicable product documentation, customer contracts, channel/provider rules, and applicable laws. You are responsible for your account users, credentials, organization settings, connected systems, customer data, campaign data, and all activity under your workspace.
Customer Data
You retain rights to data that you or your users submit to Boni One. You grant us the limited rights needed to host, process, secure, transmit, display, support, and improve the services.
Where Boni One processes personal data on your behalf, you are responsible for providing required notices, obtaining required consents or other lawful basis, honoring opt-outs, handling end-user requests, and ensuring that the data you connect to the service may lawfully be processed.
For DPDP-covered data, you are responsible for giving clear notices, collecting valid consent where required, allowing consent withdrawal, maintaining any applicable legitimate-use or customer-instruction basis, and handling Data Principal rights, grievances, correction, erasure, and nomination where you decide the purpose and means of processing.
Data Protection
Use of the services is subject to our Privacy Policy. If we process personal data for you as a processor/Data Processor, the applicable DPA or processor terms govern that processing.
Unless a separate written DPA, order form, or service schedule says otherwise, these Terms and the applicable baseline processor terms govern Boni's processor obligations for ordinary product use.
You instruct Boni One to process customer data only to provide, secure, support, troubleshoot, improve, and maintain the service; comply with law; prevent misuse; and follow your lawful configuration, integration, support, and deletion instructions.
You authorize Boni One to use service providers and subprocessors needed to operate the service, subject to confidentiality, security, deletion, and incident-support obligations appropriate to the service. We may route Data Principal requests or grievances to you when you are the responsible controller/Data Fiduciary, and you must cooperate so they can be handled within applicable timelines.
You must not use Boni One for high-risk, regulated, children's, sensitive, or special-category processing unless the required safeguards and written approvals are in place.
Integrations and Third-Party Services
Boni One may connect with cloud providers, messaging channels, authentication systems, analytics tools, AI providers, payment providers, support tools, and customer-selected integrations. Third-party services may have their own terms, fees, limits, data practices, and availability constraints.
You are responsible for authorizing integrations, maintaining credentials securely, and ensuring third-party use complies with applicable law and provider terms. You must not connect data collected without required notice, consent, opt-in, or authorization.
AI and Automation
AI-assisted or automated outputs may be incomplete, inaccurate, or unsuitable for a particular decision.
You are responsible for reviewing outputs before relying on them in legal, financial, employment, healthcare, regulated, or customer-impacting contexts.
Acceptable Use
You must not use Boni One to send unlawful, misleading, abusive, discriminatory, infringing, harmful, malicious, unsolicited, or non-compliant communications.
You must not attempt unauthorized access, bypass security controls, scrape or overload the service, introduce malware, misuse APIs, or process data in violation of law or another person's rights.
Security
You must keep credentials confidential, use strong authentication where available, promptly notify us of suspected compromise, and ensure your users have appropriate permissions.
We may suspend or limit access to protect the service, customers, users, or third parties.
You must promptly notify us if customer data, connected systems, integration credentials, or workspace access may have been compromised so we can assess security, breach, customer, Data Principal, or regulator notification duties.
Fees, Taxes, and Payment
Paid services, invoices, taxes, usage limits, renewals, refunds, and cancellations may be governed by separate order forms or product schedules.
Unless a separate written agreement says otherwise, fees are non-refundable once paid except where required by law.
Intellectual Property
Boni websites, product interfaces, logos, software, documentation, designs, and platform materials are owned by or licensed to Boni. You may not copy, modify, distribute, reverse engineer, or create derivative works from Boni materials unless expressly permitted.
You retain rights to your organization data and customer content. By using Boni, you grant Boni the limited rights needed to host, process, secure, and operate the services for your organization.
Service Changes
We may modify, improve, suspend, or discontinue features.
We will try to handle material changes thoughtfully for active customer workflows, but we do not guarantee that every feature will remain available indefinitely.
Disclaimers and Liability
Boni services are provided on an as-is and as-available basis unless a separate written agreement states otherwise. We do not guarantee uninterrupted availability, error-free operation, or that every workflow will meet every business requirement.
To the fullest extent permitted by applicable law, Boni is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the services.
Termination
We may suspend or terminate access if you breach these Terms, create security or legal risk, fail to pay amounts due, violate provider rules, or use the services in a way that may harm Boni, customers, users, or third parties.
After termination, data return/deletion will follow the applicable agreement, law, and backup retention process.
Governing Law
These terms are governed by the laws of India. Courts located in Bengaluru, India will have jurisdiction for disputes arising from these terms, unless a separate written agreement specifies otherwise.
